James’ story isn’t an isolated/localized perfect storm. We’re not saying, “the Kentucky State Government is a complete failure”, what we are saying “James’ experience has uncovered many points of failure.” 

Emergency Custody Hearing, The Dad is not allowed to testify or present evidence.

Failure to pay Meth-Support. The Dad is not allowed to testify or present evidence.

We Petition, that James’ and his children’s hardships be allowed to result in vast improvements.
That can only happen through a full review of his allegations by the LRC

permits our
COUNTY GOVERNMENTS
to commit these crimes,
without change,
we don’t need either!

We ask that a Congressional Inquiry to be conducted to determine if the following allegations and each of the listed elements, are true.

 

Wherefore points of failure can be turned into points of improvement, resulting in legislative masterpieces like Kentucky’s Shared Parenting Bill 528.

 

Researching the crimes against James, will make clear, the need to remove the amendment to that wonderful bill. 

We ask that a Congressional Inquiry to be conducted to determine if the following allegations and each of the listed elements, are true. We ask this, wherefore future legislation can be drafted and enacted that avoids these injustices.

Allegation 1: Unlawful Emergency Custody Hearing followed by a False Police Report

Allegation 1, Element 1

Judge Deanna Henschel a McCracken County Family Court Judge worked for the McCracken County Commonwealth’s Attorney’s Office just prior to becoming a Family Court Judge.

Allegation 1, Element 2

1.) The Prosecuting Attorney’s Office used Billy Don Waynick (a meth-addict “stepdad”) as a criminal informant.
2.) The Office of the Attorney General’s Guidelines has requirements to keep innocent people safe while allowing their C.I. to engage 

Allegation 1 , Element 3

Commonwealth’s Attorney Merdith Clymer appeared at that Emergency Custody Hearing and committed perjury, stating that there was no indication of drug use in the Waynick household.

Allegation 1, Element 4

Within 30 Minutes of the hearing Attorney Jennifer Peeler of whom was supposed to represent the children filed a false Police Report against Jame. Claiming that he was at her office intimidating her.

Allegation 1, Element 5

Attorney Shannon Powers and Attorney Marc Wells refused to enter into evidence recordings proving that James was innocent and that crimes had been committed against him.

Allegation 2: James posted bond from the false imprisonment and was re-arrested, bond revoked on two more false allegations.

Allegation 2, Element 1

A Livingston County Sheriff’s Deputy arrested James accusing him of making a false police report and for impersonating a peace officer by claiming to be some sort of anti-terrorist instructor.

Allegation 2, Element 2

The Police Report was filed by a woman named Brandi Walker. A woman that had her life threatened and the Livingston County Sheriff’s Department refused her an Emergency Protection Order.

Allegation 2, Element 3

James Samples is an, Incident Response to Terrorist Bombings, instructor. Attorney Marc Well refused to enter the certificate into the record or attempt to get his client released. 

Allegation 3: James went to Finland to seek Foreign Asylum, after returning he was assaulted, denied effective council, and charged with flagrant non-support, and is again being denied an opportunity to testify or present evidence. 

Allegation 3, Element 1

Attorney Marc Wells, wouldn’t enter evidence such as James’ certificate, recordings … James entered Alford Pleas with an agreement to stay out of trouble for two years. James left the jail and immediately left the country before they could make another false arrest.

Allegation 3, Element 2

Jailer Tonya Ray and McCracken County Detective Ben Green made a false police report against James. James was out of the country. 

Allegation 3, Element 3

James is currently being charged for Flagrant Non-Child Support. James is forbidden from being able to testify about the recording of the agents explaining Billy Waynick’s authorized drug use, the meth-related child abuse, the businesses that James lost when he was forced from the country, James’ inability to earn as a master electrician due to injuries sustained after James was returned to the United States.
